NSW Land Registry Services (NSW LRS) has introduced a new ‘smart’ digital Section 88B Instrument, enabling lodging parties to prepare the document more easily and with less chance of administrative errors.
The digital Section 88B Instrument complements the existing manual Instrument, giving lodging party’s choice in how they prepare the document for lodgment. Both Instruments are available in the NSW LRS Online Forms Library under Deposited Plans.
Section 88B Instruments set out terms of easements or Profits à Prendre to be created or released, and of restrictions on the use of land or positive covenants intended to be created pursuant to Section 88B of the Conveyancing Act 1919.
Key benefits of the smart Section 88B Instrument are:
- Data entered into common fields is automatically completed in subsequent parts of the form, reducing the need to repeatedly enter information and the chance of data discrepancies.
- 88Bs are simpler to complete with the ability to add extra sheets or delete unneeded sheets.
- Digital functionality allowing information to be inserted from drop-down listings
- In-built business rules:
- Automatically update page numbers when new sheets are added.
- Highlight inconsistencies with sequential data such as dates.
- Check data formatting such as auto-capitalisation and mandatory numeric fields.
- Allow users to check fields prior to lodgment, including spell check and displaying specific data fields relevant to the plan being lodged (for example, showing the Survey Certificate No. only where required).
A number of customers and lodging parties participated in the development and testing of the interactive Section 88B Instrument and we thank them for their valuable feedback during this process.
Making it easier to prepare and lodge plans
The introduction of the digital Section 88B Instrument follows the launch of digital Administration Sheets for Deposited, Strata and Community Plans in July 2019.
These projects seek to reduce the likelihood of lodging parties submitting incomplete or incorrect documentation to NSW LRS, which can delay plan registration and frustrate our customers and in turn delay their customers.
