As part of our efforts to help build a better South Australian child protection system, we are reviewing the Children and Young People (Safety) Act 2017

What's being decided?

We are seeking public input to inform the scheduled review of South Australia's Children and Young People (Safety) Act 2017.

We want to hear from a wide range of stakeholders including young people, families, carers, Aboriginal and non-Aboriginal stakeholders, advocacy bodies, service providers, other sector partners and academics. We want to know what you think our child safety responses should look like going forward, what is working well and how the legislation can be improved.

Background

The Children and Young People (Safety) Act 2017 (CYPS Act) commenced in two parts - phase 1 in February 2018 and phase 2 in October 2018.

The CYPS Act states that the Government must review this legislation and produce a report about what it finds before the fifth anniversary of the commencement of the Act. Based on these dates, the review report is due before 26 February 2023.

As part of this review, the Government has committed to consult widely. This includes supporting a number of forums in regional and metropolitan areas.

What are the next steps?

Following the review, a report will be prepared and provided to the Minister for Child Protection.

  • The final report is expected to be tabled in Parliament in March 2023.
  • Pending the report's recommendations, consultation on a draft amendment bill will take place in 2023.

    The State Government has released the report of the review of the Children and Young People (Safety) Act 2017.

    Thank you to the many organisations and individuals who engaged with the review by attending a consultation session, speaking with the review team, making a submission or completing the survey.

    The review reached over 900 people and many provided detailed responses, sharing their personal insights and experiences of the child protection system.

    The report provides an overview of the key themes that emerged across the consultation and identifies potential opportunities for legislative change for the Government’s consideration.
