TELECOMMUNICATIONS CONSUMER PROTECTIONS (TCP) CODE REVIEW 2024 PACKAGE

CA has submitted a comprehensive package of changes it proposes to make to the TCP Code to address key areas of concern highlighted by the ACMA in July 2023. In the interests of transparency, the entire package is available through the links below:

Cover Letter to ACMA;
Compendium which includes the following:
  • an introduction and ‘map’ to clearly show how the Agreed Industry Position Papers relate to the six key ‘areas of concern’;
  • 13 Agreed Industry Position Papers, with draft revised proposed code provisions included within each as relevant;
  • a draft refreshed TCP Code ‘outline’; and
  • a stakeholder feedback comment log – a spreadsheet with comments received on the ‘final draft position papers’ – and clear information on how comments were dealt with.
Review Committee Meeting Minutes

Meeting minutes for all RC meetings to date are included.

A link to feedback provided by the ACCC on the DRAFT package (sent to the RC on 17 November 2023 for response by 30 November) is also included here for completeness. This feedback was provided to CA on 18 January 2024, after the final package had been submitted to the ACMA (14 December) and could not, therefore inform the final package. Some of it may, however, already have been addressed: papers and draft outline Code included in the submitted package are substantially different in a number of areas to the November draft, with substantial updates and changes in a number of areas to reflect/acknowledge feedback received (in writing and at the last RC meeting) on the draft package. Other comments will be reviewed as part of the 2024 processes.

Note that feedback provided on the draft package by the TIO and ACCAN is documented in the stakeholder log (see compendium, above).

Proposed Regulatory Reform Package
Independent Advisor’s assessment of process
Report by IA, Michael Cosgrave, on whether the process followed for the TCP Code review and revision to date is fair, reasonable and transparent.
