WLEP 2011 amendments

The Department of Planning, Industry and Environment has finalised the amendments to Warringah Local Environmental Plan 2011 (Amendment No. 26 Warringah LEP 2011) and the amended LEP was gazetted on Friday 24 July 2020.

The amendments to Warringah Development Control Plan 2011 (Warringah DCP 2011) are now in force as a result of the notification of Amendment No.26 to Warringah LEP 2011.

At the meeting on 28 April, Council adopted the Planning Proposal and resolved to submit it to the Department of Planning, Industry and Environment to finalise the amendment to Warringah Local Environmental Plan 2011; to rezone four parcels of land from ‘Low Density (R2)’ to ‘Public Recreation (RE1)’ and to remove building height and minimum allotment size controls on this land.

The parcels include -

  • Lot 7370 DP1165551 being land adjoining 102 King Street, Manly Vale
  • Lot 7369 DP1165551 Wandella Road, Allambie, south of Jenna Close
  • Lot 7371 DP1165577, Allambie, south of Blamey Street
  • Part unmade road at the southern end of Wandella Road, King Street, Manly Vale

The amendments to Warringah Development Control Plan 2011 were also adopted.

We exhibited consequential amendments to Warringah DCP 2011 to remove residential development controls, including setback and minimum landscaped area controls from the land covered in the Planning Proposal.

Submissions were open from Saturday 23 November to Sunday 22 December 2019.

Nine land parcels subject to WDCP control E7 (development on land adjoining public open space) were not identified during the public exhibition period so the amendments were exhibited for another 28 days from 15 February to 15 March.

Please note that under the provision of the Government Information Public Access Act, all submissions will be posted on Council’s website under ‘Application Search’ against the Planning Proposal.

Any matters that you raise in a submission will be noted and taken into consideration in the assessment of the proposal, which will be reported to Council in due course.

In accordance with the Gateway Determination, the Planning Proposal seeking to amend the Warringah Local Environmental Plan 2011 (WLEP 2011) to rezone four parcels of land near Manly Creek in Manly Vale and Allambie Heights from Low Density Residential (R2) to Public Recreation (RE1) is on exhibition from 19 October to 1 December 2019.

It is also proposed to remove principal development standards (height of building and minimum lot size) that currently apply to the land.

A report went to Council on 26 February 2019 seeking approval to submit a Planning Proposal to the Department of Planning, Industry and Environment to rezone certain land in the vicinity of Mermaid Pool from Low Density Residential (R2) to Public Recreation (RE1) and to remove height and minimum allotment size controls from the land.

The parcels of land that are covered in the Planning Proposal include:

  • Lot 7370 DP1165551 being land adjoining 102 King Street, Manly Vale.
  • Lot 7369 DP1165551 Wandella Road, Allambie, south of Jenna Close.
  • Lot 7371 DP1165577, Allambie, south of Blamey Street.
  • Part unmade road at the southern end of Wandella Road, King Street, Manly Vale.

Council supported the recommendation.
