Project Information

We asked for feedback on the proposed changes to the Encroachment Policy. This Policy if adopted, will supersede the Encroachment Policy adopted by Council in February 2020.

Feedback from the community will be used to inform the final Encroachment Policy.


Background 

In February 2020, Council adopted the Encroachment Policy. The Policy is now due for further review. The Policy was developed to manage different forms of encroachments in the public realm and ensure that encroachments contribute positively on public safety and amenity, and supports the applications of the Planning and Design Code in maintaining Adelaide’s strong identifiable townscape character through strong urban form and well-defined built form edges to the street frontage.

The Policy provides the basis for Council’s assessment and decision making on encroachments in the public realm as land custodian of public roads.

The draft Encroachment Policy was approved by Council on 14 November 2023 for the purpose of community consultation.

The following diagram illustrates typical encroachments and outlines where more information can be found in the Draft Encroachment Policy.

Examples of Different Encroachments 

1. Architectural feature or external cladding. Refer to Section 4.2.1 Architectural Features and 4.2.2 External Cladding.

2. External Shading Device Encroachment. Refer to Section 4.2.3 External Shading Device.

3. Fixed Awning Encroachment. Refer to Section 4.2.4 Verandahs, Awnings and Pergolas.

4. Retractable Awning Encroachment. Refer to Section 4.2.4 Verandahs, Awnings and Pergolas.

5. Green Wall Encroachment. Refer to Section 4.2.7 Green Facades and Living Walls.

6. Under and Above Canopy Sign Encroachment. Refer to Section 4.2.8 Signage.


7. Verandah and First Floor Balcony Encroachment. Refer to Section 4.2.4 Verandahs, Awnings and Pergolas and 4.2.6 Balconies.

8. First Floor Verandah/Awning Encroachment. Refer to Section 4.2.4 Verandahs, Awnings and Pergolas.

9. Above First Floor Balcony Encroachment. Refer to Section 4.2.6 Balconies.

10. Concrete Piling Encroachment. Refer to Section 4.3.3 Ground Anchors, Footings and Pilings.

11. Temporary Ground Anchor Encroachment. Refer to Section 4.3.3 Ground Anchors, Footings and Pilings.

12. Permanent Ground Anchors. Refer to Section 4.3.3 Ground Anchors, Footings and Pilings.


What happens next?

Council will consider your feedback and finalise the policy position. All submissions received will be summarised and attached to the report to Council, at which time will be publicly accessible.

Once adopted by Council, you will be advised either by email or in writing when the Encroachment Policy will be made available on the website.

It is expected that the Encroachment Policy will be finalised and completed by early 2024.
