The Government announced in May 2021, as part of the Budget 2021-22, that Treasury would conduct a sectoral assessment to consider whether to extend the Consumer Data Right (CDR) to telecommunications.

On 22 July 2021, Treasury released the telecommunications sectoral assessment consultation paper. Responses to the telecommunications sectoral assessment consultation informed the final report, which the Minister will consider when deciding whether to designate telecommunications as a CDR sector. The telecommunications sectoral assessment was conducted with reference to the criteria set out in section 56AD the Competition and Consumer Act 2010.

On 23 November, the Government announced the release of Treasury’s final sectoral assessment report which recommends telecommunications be the third sector designated for the CDR.

The Government also released a draft designation instrument covering the scope of datasets and data holders proposed to be designated in the sector, and is now consulting on the instrument, before a final designation instrument is made.
